1. Acceptance of Terms
By accessing, browsing, and using Great Church Tools (the "Service"), you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions contained in this Terms of Service agreement ("Agreement"). If you do not agree to be bound by these terms, please do not access or use the Service. Your use of the Service constitutes your acceptance of this Agreement.
2. Service Description
Great Church Tools provides professional sermon transcription, translation, analysis, and content sharing services for churches, ministries, and pastoral organizations. Our Service includes:
- AI-powered video and audio transcription in multiple languages
- PDF and Word document export capabilities
- Email distribution and automation features
- Analytics and engagement tracking
- YouTube channel integration
- Sermon summary and analysis (Premium tiers)
- Ministry showcase and directory listings (Gold tier)
3. User Eligibility and Account Requirements
3.1 Eligibility
To use Great Church Tools, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction)
- Have the authority to enter into this Agreement
- Be authorized to represent the organization on whose behalf you are using the Service
- Not be a person or organization prohibited by law from using the Service
3.2 Account Registration
You are responsible for:
- Maintaining the confidentiality of your password and account credentials
- Notifying us immediately of any unauthorized access to your account
- Providing accurate and complete registration information
- Updating your information to keep it current and accurate
- All activities that occur under your account
3.3 Account Suspension
We reserve the right to suspend or terminate your account if:
- You violate this Agreement or any applicable law
- You provide false or misleading information
- You engage in fraudulent or abusive activities
- You abuse our resources or attempt to disrupt the Service
4. User License and Restrictions
4.1 Limited License
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful purposes in accordance with your subscription tier.
4.2 Prohibited Uses
You may NOT:
- Copy, modify, or create derivative works of the Service or its contents
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
- Remove, alter, or conceal any copyright, trademark, or proprietary notices
- Use the Service for any commercial purpose outside your paid subscription
- Rent, lease, transfer, or sell access to the Service
- Upload, transmit, or distribute viruses, malware, or harmful code
- Engage in unauthorized access or hacking attempts
- Violate any applicable laws or regulations
- Harass, abuse, or threaten other users or staff
- Spam or send unsolicited communications
- Attempt to bypass security measures or throttling limits
- Use bots, scrapers, or automated tools without permission
- Distribute copyrighted content without authorization
- Use the Service to transcribe or distribute content that violates third-party rights
4.3 Acceptable Use Policy
Your content must:
- Be owned by you or you must have permission to use it
- Not infringe on any intellectual property rights
- Not contain hate speech, discrimination, or illegal content
- Not defame or harm individuals or organizations
- Comply with all applicable laws and regulations
5. Intellectual Property Rights
5.1 Our Intellectual Property
The Service, including all software, text, graphics, user interfaces, visual effects, and other materials, are the exclusive property of Great Church Tools or its licensors. All rights are reserved.
5.2 Your Content
You retain all ownership rights to content you upload (sermons, videos, documents, etc.). By uploading content, you grant us a non-exclusive license to:
- Process and transcribe your content
- Store your content on secure servers
- Create backups for security purposes
- Analyze your content to improve our Service
- Display your content in accordance with your privacy settings
5.3 Limitation on Our Use
We will NOT:
- Sell your content to third parties
- Use your content for marketing without permission
- Share your content with competitors
- Modify your content except as necessary for transcription and formatting
5.4 Generated Content
Transcripts, summaries, and analyses generated by our Service are based on your input. You own the transcripts and may use them for your ministry purposes. We retain rights to our AI and algorithms.
6. Subscription and Payment Terms
6.1 Pricing and Billing
- Pricing is displayed on our Pricing page and is subject to change with 30 days notice
- Billing occurs on the date your subscription renews each month or year
- You are responsible for providing accurate billing information
- We accept all major credit cards and PayPal
- Billing is processed through secure third-party payment processors
6.2 Refund Policy
- We offer a 30-day money-back guarantee if you're not satisfied
- Refund requests must be made within 30 days of initial payment
- Monthly subscriptions are non-refundable after 30 days
- Annual subscriptions may be prorated if cancelled within the guarantee period

6.3 Cancellation and Termination
- You may cancel your subscription at any time from your account settings
- Cancellation takes effect at the end of your current billing period
- You will retain access until the end of your paid period
- After cancellation, your account will be downgraded to Free tier
- Data may be deleted 12 months after account closure
6.4 Overages and Additional Charges
- If you exceed your subscription limits, we will notify you
- Additional transcriptions may be purchased individually or by upgrading
- Usage overage charges will appear on your next invoice
6.5 Price Changes
We may change prices at any time. We will provide 30 days notice of material price increases. Changes take effect on your next billing date. Continued use after notice constitutes acceptance of new pricing.
7. Service Availability and Uptime
7.1 Availability
We strive to maintain 99.5% uptime for our Service. However, we do not guarantee uninterrupted access.
7.2 Scheduled Maintenance
We may perform scheduled maintenance with 24 hours notice via email. Maintenance typically occurs on weekends.
7.3 Service Interruptions
We are not liable for:
- Unplanned outages or technical failures
- Service interruptions due to third-party services (YouTube, AWS, etc.)
- Network issues or internet connectivity problems
- Acts of God, natural disasters, or force majeure events
8. Disclaimer of Warranties
8.1 "As-Is" Basis
The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. Great Church Tools makes no warranties, express or implied, regarding:
- Merchantability or fitness for a particular purpose
- Accuracy or completeness of transcriptions
- Non-infringement of third-party rights
- Uninterrupted or error-free operation
- Compatibility with third-party services
8.2 Transcription Accuracy
While we use advanced AI technology, transcription accuracy is not guaranteed. Transcriptions may contain errors, especially with:
- Poor audio quality
- Strong accents or dialects
- Technical jargon or specialized terminology
- Background noise or multiple speakers
- Specialized religious or cultural references
It is your responsibility to review and edit transcripts for accuracy.
8.3 No Professional Advice
Our Service does not provide legal, financial, medical, or professional advice. Sermon analysis and summaries are for informational purposes only.
9. Limitation of Liability
9.1 Exclusion of Damages
IN NO EVENT SHALL GREAT CHURCH TOOLS, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of revenue, profits, data, or business opportunity
- Damage to reputation or business interruption
- Any damages arising from your use or inability to use the Service
9.2 Liability Cap
Our total liability for any claim arising from this Agreement shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
9.3 Exceptions
These limitations do not apply to:
- Gross negligence or willful misconduct
- Violations of applicable law that cannot be limited
- Indemnification obligations
10. Indemnification
You agree to indemnify, defend, and hold harmless Great Church Tools, its affiliates, and their respective directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:
- Your use of the Service
- Your violation of this Agreement
- Your violation of any applicable law
- Content you upload or distribute
- Your infringement of third-party rights
11. Third-Party Services and Content
11.1 Third-Party Integrations
The Service integrates with third-party services including YouTube, Google, payment processors, and email providers. Your use of these services is subject to their terms of service and privacy policies.
11.2 Links and External Sites
We are not responsible for external websites, content, or services linked from our Service. Use of external sites is at your own risk and subject to their terms.
11.3 No Endorsement
Inclusion of links does not imply endorsement. We do not verify accuracy or appropriateness of external content.
12. Content Moderation and Removal
12.1 Right to Remove Content
We reserve the right to remove, suspend, or restrict access to content that:
- Violates this Agreement
- Violates applicable law
- Infringes on third-party rights
- Contains hate speech, violence, or illegal activity
- Is reported as harmful or offensive
12.2 DMCA Compliance
We comply with the Digital Millennium Copyright Act (DMCA). If you believe content infringes your copyright, contact support@greatchurchtools.com with:
- Your name and contact information
- Description of the copyrighted work
- Location of the infringing content
- Statement of good faith belief
- Your signature or digital signature
12.3 Content Restoration
If you believe content was removed in error, you may submit a counter-notice.
13. Data and Privacy
13.1 Privacy Policy
Your use of the Service is governed by our Privacy Policy. Please review it carefully.
13.2 Data Security
We implement industry-standard security measures. However, no system is 100% secure. We are not liable for unauthorized access to your account or data.
13.3 Data Retention
- Account data is retained for the duration of your subscription plus 12 months
- Sermon content is retained in your account until you delete it
- Backup copies are retained for 30 days after deletion
- Transaction records are retained for 7 years for compliance
13.4 Backup Responsibility
While we maintain backups, you are responsible for maintaining your own copies of important content. We recommend regular exports of your transcripts and data.
14. Google Ads Compliance
14.1 Compliance with Google Policies
Great Church Tools complies with Google's advertising policies and requirements:
- We disclose use of Google Ads and tracking technologies
- We provide transparent data practices
- We respect user privacy preferences and provide opt-out options
- We do not promote prohibited content
- We comply with GDPR, CCPA, and applicable data protection laws
14.2 Restricted Content
You agree not to use the Service to promote:
- Illegal products or services
- Counterfeit or fraudulent goods
- Dangerous products
- Deceptive or false claims
- Hate speech or discrimination
- Weapons or explosive materials
14.3 Transparency in Advertising
If you purchase Google Ads to promote your ministry:
- You must comply with all Google Ads policies
- You are responsible for the accuracy of your ads
- You must provide clear disclosures about your organization
- You assume all liability for your advertising content
15. Modifications to Service and Terms
15.1 Service Changes
We may modify the Service at any time, including:
- Adding or removing features
- Changing pricing or subscription tiers
- Modifying usage limits
We will provide notice of material changes when practicable.
15.2 Terms Modifications
We may update these Terms at any time. We will notify you by email or prominent website notice of material changes. Continued use of the Service after changes constitutes acceptance of new terms.
16. Governing Law and Dispute Resolution
16.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
16.2 Jurisdiction
You irrevocably submit to the exclusive jurisdiction of the courts located in the State of New York.
16.3 Informal Resolution
Before initiating legal proceedings, we encourage you to contact us at support@greatchurchtools.com to resolve disputes informally.
16.4 Arbitration
For disputes not resolved informally, you and Great Church Tools agree to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than court proceedings.
16.5 Class Action Waiver
You agree not to bring class action lawsuits against Great Church Tools.
17. Severability
If any provision of this Agreement is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
18. Entire Agreement
This Agreement, including the Privacy Policy and any other policies referenced herein, constitutes the entire agreement between you and Great Church Tools regarding your use of the Service and supersedes all prior and contemporaneous agreements.
